A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §3-1-2b, relating to elections; and providing general rules for all county and municipal referendum votes.

Be it enacted by the Legislature of West Virginia:

That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §3-1-2b, to read as follows:

ARTICLE 1. GENERAL PROVISIONS AND DEFINITIONS.

§3-1-2b. Referendum elections.

(a) Notwithstanding other provisions of this code or of any county or municipal ordinance to the contrary, all municipal or county elections for the purpose of voting upon any public question submitted to the people of a county or municipality may only be held during general elections, unless the parties requesting a referendum vote pay for the cost of a special referendum election.


NOTE: The purpose of this bill is to provide general rules for all county and municipal referendum votes.
